Generally, there may be provisions in your lease or contract including force majeure, government order provisions, impossibility provisions, or other provisions of law which may excuse or delay performance under a lease by either a landlord or a tenant. We are currently assisting our clients to review leases, negotiate and draft lease modifications to include reduction or deferral of rent, surrender, or such other workouts necessary to best protect their interests. We also provide legal analysis of commercial leases and business contracts to assist you in posturing these negotiations.


With some exceptions, the New York State Supreme Court is currently accepting the filing of new cases, hearing and resolving motions, and handling many matters in cases through virtual appearances.  The Landlord/Tenant Court is now accepting the filing of new cases and is beginning some trials in Kings County.  The Federal Court and Bankruptcy Court, although physically closed to the public, are accepting new cases and other applications by e-filing and conducting hearings by phone. This includes applications by landlords to vacate bankruptcy stays. If you are a landlord and have received notice that your commercial tenant has filed bankruptcy, we can provide assistance. The American Arbitration Association is accepting arbitration and mediation filings and conducting virtual hearings.


We are prepared to negotiate, draft and close real estate sales, refinances, and leases. Closings can be conducted virtually.
