As the economic and legal effects of Covid-19 continue to evolve, we wanted to update you on the status of the courts and some of the services we may be able to provide to help you.
STATUS OF THE COURTS
The moratorium on Covid-19 related residential and commercial evictions expired on January 16, 2022. Both the New York State Supreme Courts and New York City Civil Courts are accepting filing of new cases and conducting trials and hearings.
Federal Courts and Bankruptcy Courts are also continuing to accept new cases and other applications via electronic filing and conducting telephonic hearings. Similarly, the American Arbitration Association is accepting arbitration and mediation filings and conducting virtual hearings.
COVID-19 RELATED LEGAL ISSUES, COMMERCIAL LEASES, AND OTHER CONTRACTS:
Generally, there may be provisions in your lease or contract including force majeure, government order provisions, impossibility provisions, or other provisions of law which may excuse or delay performance under a lease by either a landlord or a tenant. We are currently assisting our clients in reviewing leases, negotiating and drafting lease modifications, surrender agreements, or such other workouts necessary to best protect their interests. Many Covid-19 related issues and defenses are being raised during litigation, especially in landlord/tenant cases. Our firm is also familiar with, and has litigated, various legal issues related to the Covid-19 pandemic including but not limited to claims by tenants of impossibility of performance and frustration of purpose. We can also provide our clients with legal analysis of commercial leases and business contracts to assist in posturing these negotiations or commencing/defending litigation.
We are fully prepared to negotiate, draft and close real estate sales, refinances, and leases which continue to be conducted virtually.
